Wills

Les Pearson

Hi
Getting ready to update ours wills before we move to Kuching in February 2020.
1.  I note that Malaysian Law required Malaysian resident who dies in Malaysia, must be buried in Malaysia, whereas Non-Malaysian residents are to be cremated and repatriated.
2.  What happens to a resident who lives in Malaysia on a MM2H visa.  Can they be cremated, and do they have to be repatriated?
3.  If they can be cremated are there any restrictions as to where ashes can be spread.
4.  Is there any different laws in Sarawak relating to this?

Nga mihi
  Les

My advice is to contact a lawyer in Malaysia who handles wills. You can get a list of such lawyers from the New Zealand High Commission in KL. Alternatively try contacting the Malaysian Embassy in Wellington to seek more information. When I had my MM2H I made a will free of charge through HSBC bank who were offering it at the time. But unfortunately didn't really enquire about cremations, burials or repatriation.

Another possibility is to contact the local crematorium or columbarium.

This article indicates that while those on work permits are required to be cremated and the remains repatriated, those on the MM2H visa may be cremated or buried in Malaysia.

Traditions in Malaysia are very much in having a "place" for descendants to visit the remains so columbarium and cemeteries are fairly standard. Do they allow the urn to be carried home for "private arrangements"? Don't know? Also the scattering of ashes  somewhere probably would be unclear though not covered by law. However many traditional societies (orang asli) groups did practice cremation and there is no evidence that they did anything other than leave the ashes at the site of the pyre. The spirit was released into the other world.

It would also be interesting to know about the provision of ones corpse to a local Medical School or University for training and research.

Here is some information regarding the Silent Mentor Program for contribution of your own body after death to Medical Schools. Unfortunately it states that they only allow Malaysian citizen contributions. It would be nice to open this up to non-Malaysians.

I mention this because it states that, in response to a question, the Program states they will arrange for a scattering of ashes off Port Klang in the Straits of Malacca.
