RESIGNATION & TAX CLEARANCE

Dear all,

I have several questions to ask:-

1. Can the expatriate resign after the work permit expired? 
2. Can I do the tax clearance after the expiration of the work permit?

You are apparently in Malaysia.

Is that correct?

Where would you want to work if outside Malaysia?

If you decide to post again here, consider what questions an immigration or labor or tax attorney might ask you if you consulted him or her professionally .. and consider providing details of your situation that might satisfy their questions.  The more you tell us, the better you can be guided.

You should be able to resign any position if there is no valid work permit still in effect.

Any employer would be acting illegally in most jurisdictions if trying to compel continued employment absent a valid permit.  This does not mean that no unscrupulous employer ever attempts to compel such continuing employment.  We had a recent poster on this site claiming such was occurring in her case.

Tax laws vary by jurisdiction.  Of course multiple taxing authorities may be involved when an Expat is working outside the country of origin.

The answer depends on the locality, as the laws on this vary from country to country.
Thus please post this in the appropriate country forum.

For Singapore, which has similar laws as Malaysia in many respects, the answer is:
An employment contract is automatically voided when the associated work pass expires (or is cancelled). Thus there is no need to resign in this case.
Tax dues must be clarified (and paid for from the withheld last month salary) by the employer and IRAS. They would contact you if any input from you is needed.
