getting an F1 Visa from the UK with an expunged criminal record?

Hi there.

I hold Hong Kong and United Kingdom passports.

I am thinking about applying to USA universities from the UK.

I previously applied from Hong Kong in 2017 and was accepted by several schools, however, I was arrested for drug possession and soft theft in Hong Kong and decided not to take any offers because I thought my F1 visa would have been denied so soon after having a criminal record.

It is now 2020 and I would like to apply for entry for 2021, will I get my F1 visa this time? Is it any different from the UK to US as opposed to HK (Hong Kong) to US? I believe that the HK criminal record is expunged after three years (I have not got a record in the UK).

I would not like to waste all the money on applications and then find out that I cannot go into the country.

Any help and advice would greatly be appreciated!

Hmmm. I have never heard of a criminal record being expunged except for something possibly done as a minor – or if one was eventually exonerated of being falsely convicted. Why would this happen?

And I don’t have a definite answer to your question but would relate an experience that happened to a Brit I know personally. He was caught with a joint flying into the UK over 30 years ago. The case got dropped – no conviction. Yet on the basis of this he was denied a green card in America where he was living. He managed to stay in America, I think on temporary basis but I am not even sure of the legality of how he might have done it. He was a respected person in his community and married an American woman with children. Then Trump came in and within a year he was deported.

Charges, none the less convictions, for drugs or violent crimes can be shared by many countries and create problems. In the end, if you really want to try, then just do so. But getting caught in a lie can mean a ban where admitting to some transgressions might be tolerated. But like twostep mentioned, the question asked will be “were you ever…
