Divorcing in Kenya

Reaching the decision to seek divorce can be hard. Filing the papers as an expat in Kenya can be as taxing since a good grasp of legislations is needed and the process can prove to be tedious.

Where and how do you apply for a divorce in Kenya? How long does it take for the process to be completed?

If the couple has children, which measures can be taken in order to protect their interests?

Good afternoon Diksha,

Going through a divorce can be a gruesome, stressful and tiring experience. It even becomes worse when you are in a foreign country and children are also involved because you'd be torn between going ahead with the divorce and protecting your children. I'd advice that you try to remain strong for the sake of the children and keep their best interests at heart as you contemplate on divorcing your partner.

For the divorce process, you are supposed to file a divorce petition to the same effect. However, you must prove that the marriage has irretrievably broken down and there is no hope of salvaging it.

I would therefore advice that you get in touch with an Advocate who will guide you throughout the process and give you several options that you have to safeguard the interests of the children.

During the divorce process, the issues that will arise with regards to the children will be mainly the custody of the said children and their maintenance.
