New and old expat status

Dear all,


I wonder if anyone falls in my category and share the same issue:


I came to Belgium in 2021 with the old expat status reducing my tax burden. After a few months, my company informed me that the old status would be replaced with a new one and I could apply for the new one or keep the old one until latest December 2023.


Since I was working in Netherlands last in summer 2017, I didn't meet the so-called 150km rule so I didn't qualify for the new status. This meant I would lose a lot of net income starting from January 2024. The financial implications are so that I am thinking to leave Belgium by December 2023.


Anybody with similar problem? Any solution? Maybe we could pursue a group legal or class action against this unfair treatment?

You just need to negotiate with your company, I think this is the only visible way. I also received a letter that starting from December 2023 I will lose my expat status.

@ievgenfeldmann Negotiate what? Matching my net loss through raising gross or negotiating to grant the new expat status?


My company says they would not bother applying for me as I simply don't meet the government required 150km rule.

By the way, if you want more solutions, as far as I know, you could move across the border in Germany and remote work for your Belgian employer through many so-called "global employment" companies.


In Germany, 60% of your gross will be net. In Malta (big plus, English speaking) 65% of your gross will be net. In Cyprus (negative, no English) 67% of your gross will be net.


Compare these with lousy Belgian net of 45% and unstable laws who target expats to patch government budget holes lol


Nevertheless, I am still hoping for a solution to stay in Belgium, I have till September when I will switch to leaving Belgium mode.

@Dr.Lefty I remember you can keep status but salary has to be 70 k plus

@ievgenfeldmann Really? You mean the old status can be kept beyond December 2023 if gross salary is over 70k/annum? That'd be great! Do you have a link or reference? Thanks in advance!

As far as I can see, everybody says holders of the old-expat status will lose the benefit from December 2023. No mention of  >70k salary threshold to prevent this.

Well the problem is you need to meet the conditions of new status from the date you started working in Belgium, for me i met the conditions like gross salary etc in 2022 but in when they look back in 2018. Truely speaking company has nothing to do with this as it is your personal tax situation, you just need to pay the tax what a local person pays. It is with you and government. I will also be loosing the expat status in 2024 and company told me it will be around 200-300 euros less net.

There was a transition period in 2022 if you met all condations you will get new tax status but now nothing can be done.

Yes I know what you say. But "ievgenfeldmann" appeared to suggest one could keep the old status into 2024 if his or her gross salary was over 70k.  I am yet to see a proof of that anywhere online.

My net loss is more I think. But I am not going to stay in Belgium: there is no way in hell I pay more to those bureaucrats in brussels, I am single with no kids and don't load the social system plus bring a wealth of education and experience for free to this tiny irrelevant piece of land.


I will move either to Germany or Malta as my company allows remote working. I will make a whole lot more net. Screw Belgium.

You can only move to said counties if you have a visa (a non EU citizen)

Again it is your personal choice if you find anywhere else better then no body is stopping you to go you, also came here by your choice.

I can because I have three nationalities and I use them as they serve me. For the said move, I'll use an european passport.

I came here because I thought a deal was a deal. Didn't think of untrustworthy bureaucrats in brussels and sudden decision to target people like me and cut their tax benefit to patch budget holes. They thought they could squeeze more tax revenue out of people like me, but in my case, they are going to lose all of it soon.
