Tax refund from interest from fixed accounts

Hello all, hope someone can help me as I have some problem with CM Tax Office with my refund from fixed accounts.

I have given them all the necessary papers : Bankletter saying how tax was deducted, Passbook showing same, Passport with all pages, ID of landlord, Lease of condo, Form 90 filled out with help from Tax.

They still want Tambien Baan and Chanot from my Landlord which she refuse to give.

Any suggestions would be appreciated, thanks.

Perhaps they will accept residence letter from immigration.

Firstly you need to know if you are resident or non resident in Thailand as if you claim the tax back that mean you have declared it in paid it abroad

I discussed in the past with my banker and I decided to not claim as it is a way for them to know how much you have in bank and with all corruption going on need to be careful

In all the cases you have to pay taxes if your earn money here abs stay over 180 days per year

There are so many fake document like rental contract etc that they will not trust them and you put the owner in trouble too as many of them does not declare rental income and you are in the right service reason why the owner will not give you any positive reply as he is going to have big problem not for current year but fines for all the previous years too

Thanks for your answer - I´m resident in Thailand with thaiwife. If it was peanuts to get refunded I wouldnt mind and just let it go but 20,000+ is worth some Work I think.

I know the landlady is not interested in having Tax Office knowing about her rental income but they already know since we have told them and Tax Office guy have spoken to our landlady telling her what doc they need from her.

Example : I can imagine if we rented from an American that went to US for months then I couldnt get my tax refund cause the landlord was not in Thailand - sounds weird to me and I can tell that thaiwife got her tax refund after 5 days - check in mail - check to bank - 2 days later Money on her account ...

The definition ( http://www.rd.go.th/publish/6045.0.html ) is :

1.Taxable Person
            Taxpayers are classified into “resident” and “non-resident”. “Resident” means any person residing in Thailand for a period or periods aggregating more than 180 days in any tax (calendar) year. A resident of Thailand is liable to pay tax on income from sources in Thailand as well as on the portion of income from foreign sources that is brought into Thailand. A non-resident is, however, subject to tax only on income from sources in Thailand.

I will not say 20K is peanut but mine was over 60K in tax, and I give up.... in my home country it will be the same, usually it will be 20% tax deducted by default in Europe.

Other solution is to put your saving under your child name if you have some and no tax will be deduct.

Although taxes are due on income from sources in Thailand the first 150k baht is except from taxes.  You also have a list of allowances that push that number higher.

By Thai law she has to report you as a resident in her premises within 24 hours after your arrival, could you use this to get a copy of her house book and signed copy both sides of her I.D.? Immigration won't help you, but between you and her, maybe she would relent if she knew she was in violation of the law. (Who ever to report you as a resident in the home, with the local police within 24 hours of your arrival.)
