Seizure in Italy?

Hello everybody,

in Germany, there's the Pfändung, seizure in English. So if you have depts and no possibility to pay them, the bailiff comes to you and confiscates things. But some objects are safe (cannot get confiscated like these https://www.schuldnerberatung.com/pfaen … det_werden) How is it in Italy, is there also Pfändung and what can get taken and what cannot?

In Italy a seizure can be disposed on things and properties. However there are some limits, for example:

Sacred objects - clothes - beds - fridge - washing machine and all things which are necessary for the dignity of the person (the debtor). Also if you have a salary, this can be seized too, and any income can be, however if you have a pension and under certain limits, this cannot be seized.

Generally talking, all those things which are necessary for your dignity and life cannot be seized.

Maybe it would help if you made a more specific question, as the list might be very long.

Hi,as already post by Luxury Law,the list might be a little long but let's first say that there is an important difference if the debt is with a private (banks,insurance companies or firms and so on) or with the Italian IRS, i.e. Agenzia Entrate Riscossione, with the latter not allowed to seize your primary house,if you own a second house/Flat it can be possible if over 120.000 euros' value.
Instead privates via Judge/magistrate decision can seizure almost all of your belongings with the exempion of primary stuffs as already posted:and your monthly salary can seized no more than 25 % of the total,your bank account seized only the amount excessing more or less around 1.200 euros,if you have legally registered weapons (shotgun handgun etc.) those cannot be seized and sell in public auctions, retired persons could get their pension seized no more than 25 % and so on,quite long list,sorry  :joking:
