New ETC Guidelines published

I just came across the new Guidelines as of 10 th June.They are available from the ETC website.

My first impression is that , for third country nationals , they are much more restrictive than before and don't leave much room for individual consideration.

Here are just a few details:

Application for TCN(third country nationals) has to be made by employer who also has to pay for private health insurance.

If the TCN is already in Malta there is a new health clearance form.

Evidence of job search for an EEA citizen has to be provided including efforts made by ETC themselves and through EURES in the whole of Europe.Only then can the application be accepted from a ' labour market perceptive.

The employer has to provide and pay for private health insurance .

Work for TCN must be full time and no self-employment is allowed.

'At present' TCN work permits can be renewed a maximum of threee times.That would mean 1 application plus 3 renewals = a maximum of 4 years work in Malta.

Well, as far as I can see , and if the ETC follow their own Guidelines,things will become very difficult for TCN to get a work permit in Malta unless they are highly qualified and working in areas where there is no alternate employee in Malta or even Europe!

We would be greatfull for feadback on these Guidelines and how the ETC use them at the moment.

Hi all,

Got some info today that the ETC does not accept leaving the Schengen zone for a few days as a valid new visa for third country nationals ! They declined a work permit with that reason .
In the past this was accepted.If this a new procedure that is even stricter than the actual immigration checks it would make it nearly impossible for third country nationals to apply for a work permit when they are already in Malta as the process takes longer and after 3 months you will have to leave and not be allowed to return before another 3 months for the visa to be valid for the ETC .

If this is a new rope to jump it will make things a lot more difficult. Will keep you updated .......
