No, they should get the residence permit for you within 2 months of arrival. If not you are staying illegally and the visa might have expired already and if you company wants to renew it they end up paying fine. But now under the grace period there is option to correct your situation without paying fine.

Dear Mr.Gurru

I need your support to release my tension for below queries;

1- I new arrived in KSA and gave all paper to my sponsor for Iqama but still waiting, The company is in "White" category,so can Govt issued the Iqama ?

2- Can I transfer to Green-Company without get the Iqama due to grace period?

Really Thanks and appreciate for your support.

BR,
Ahmad

Out pass you can get and leave.

Medical test before 7 months is not valid any more.

Approach labor office for any issues that you need to resolve, if its to get final exit or to get release and iqama made to new sponsor.

It will be difficult as long as company stays in yellow, if they correct their situation and be in green your iqama will be renewed.

Will one of you please explain to me what red, yellow, and green categories mean?? I see these mentioned often, but have no clue about it.

The quickest summary I've ever seen is here:
http://www.bayt.com/en/employers/recrui … udization/

Have a look at the lower part of the page starting at "About Nitaqat"

Companies referred to as falling in the "Premium" category mentioned on the bayt.com page you posted above are Platinum category companies, yes? My prospective employer is in the Platinum category, and going by what's mentioned on that page, I should not have to worry about the 2 years restriction even after the amnesty period has elapsed?

Best regards.

The 2 yrs restriction doesn't apply on you. Your understanding is correct.

Thank you for the reply, TLL. Much appreciated.

Best regards.

thanks sir

Dear if the company is under yellow how can we renew over iqama.is that possible that iqama can be renewed??

Companies that fall under the Yellow category can renew work visas for each foreign employee on the condition that the employee has not spent more than six years in the kingdom. Yet, they cannot transfer visas of non-Saudi workers to fall under their own sponsorship.

Hello everyone. I am working at MOH hospital in Riyadh since nearly  seven months as an ER specialist. I signed my contract based on my UK degree qualifications which was authenticated by  saudi embassy attache and embassy inUK and also by the UK college.
I was working for 6 months as an er specialist. During this time I had submitted  the documentsrequested by the hospital for Saudi commission. This process dragged till a few days back when on asking the HOP dept they informed me my UK degree is notrecognised and if I am wiling to work as a resident they will proceed with the saud commission and iqama processing. I refused as this was against the contract I signed.
The hospital  ER dept anyway put  some of my duties in resident rota and I refused to do it to which I had already spoken to the hod of ER.
Please let me know what my options are. My life here has become a living hell without iqama , no saudi commission and this too in the 7th month.
Can I offer resignation with imediate effect citing the saudi commission does not recognise my degree and also Iqama has not been issued. If I can resign do I have to give the MOH hospital one month notice.
Does the 90 day rule within which iqama has to be issued apply to private companies oly or to all? Please all valuable inputs are welcome as I am sure there are many people who ave been suffering.
Thanks in advance.

@DadManny, sir may i know what happen to the situation of your son? And what are the advice that the embassy told to you, because unfortunately i have the same situation as yours.

@hrguru,

You can approach the labor office and passport office and ask for an exit in this case and they will grant you exit, I suggest you contact your embassy first and discuss options with them on repatriation.

Will it be possible sir?  Because i really want to go to the embassy office but i cant because i know i cant ride in a bus  because i have no iqama.

And they took also my passport because they say they need it for processing my iqama. I dont have anything like what they say temporary iqama or waraga.

Perhaps a friend can inform the embassy or I am sure there is a number at the embassy for the labor relations that you can call and inform them about this.

Would company cant hold me back in this situation? I mean. Will they still let me pay if i choose to exit due to non issuance of iqama?

This would depend on the outcome of the case and the agreement you will reach with your employer if you go to court. If you arrived recently and then is asking to go back due to various reasons caused by the sponsor he will agree for an exit but with condition not to pay anything further since he already paid for the visa / ticket - to bring you here.

Thank you for the advice. But you think sir how long will it takes?

This is a great question with no answer. It can take long time or weeks depending on the compliance from your sponsor and other legal factors. There is no way for me to comment on the time line.
