Hello avvuralgokhan,

Thank you for sharing useful legal tips.

Could you please tell me if you are a lawyer yourself?

Are you an expat in Turkey?

Cheers,

All the best,

Bhavna

In case of purchasing a good from an e-commerce platform, consumer is eligible for a termination of the contract free of charge and can demand a refund, however he/she might be forced to pay the transportation cost to send the relevant good back depending on the platforms policy.

(Legislation of protection of the consumer Cl.48 and relevant edict)

@Bhavna

Dear Bhavna,

This thread is opened up by me to help the foreigners in Turkey, explicitly helping them with day-to-day legal matters.

However i would love to have your thoughts around if what i am doing is anyway shape or form breaches the forums guidelines;

If so i would not hesitate to remove it myself however i assume you could have done that by yourselves anyway, happy to have your thoughts anyway.

Regards

@avvuralgokhan

Foreigners whose profession is tied to a license must apply to obtain a prior license from relevant authority in order to legally work in the country.

(International workforce legislation Cl. 8 and relevant statute)

You made some quite some posts, but nothing concrete I have to say, I do NOT need a lawyer, but a member might confirm (or not) that pensions are not taxes, so far as I understand any pensions/retirement benefits below EUR 10 K are ignored (what above?).

Also capital gain on properties, I understand after 5 years it is free, can I understand that after living here with Ikamet for 3 years you pay 40%.

Easy questions and practical, do not please go through PM. For many of the subscribers it is relevant and should not be a secret.

Any serious real estate agent should be able to confirm.

Please give some concrete feedback. (easy)

I am happy to pay for lawyers for many topics, but the feedbacks so far on the forum has not given value.

@avvuralgokhan Please focus on those clients who can pay, pensioners, people with cash, but give some concrete things, not things which is tsoo general or anbody knows anyway,

@avvuralgokhan Give value input and you will get your clients, not by being neutral and saying nothing, my real estate agency had helped me quite a bit.

One line of business is extention of driving license (I was in time (research)). But some people forgot, have to take examanations, failing, dricing lessons, ...)

Take the money where you can

@avvuralgokhan Please help forum members, not posting generic items. Better to get one big compensation than 10 small I think.

Eg creating a company which services Luxembourg, what would it take, what would it cost, what are the expenses, what can be set off.

Nothing, nothing so far on companies, please do.

If you are good, you are good and possibly get business (I am sure you have a good accountant connected)

I had my own in Hungary (quite satisfied), paid my lawyer, accountant, ... no problem.

Getting money for money, easy, no vague posts please

@cdw057 I had a client who was an expat who thought exactly like you did at the beginning.

Then it turned out the place he sought to buy was far from perfect. If they were to consult some professional in the beginning, this would never have happened, since there are bad incentives in the market. I quite honestly think that your attitude is clingy and rude, even if you were able to give me millions i would not be working for you. And don't get me wrong this thread is created to help foreigners understand their day-to-day lives and transact in the best possible way. If that didn't suit you, be my guest and unsubscribe. you are more than welcome to do just that.

I will however answer your question since you won't let us have a peace of mind without it. The tax you mention in both areas are called "income tax" and yes hold your property for 5 years to not pay it, for pensions it's a different story you mentioned that you get multiple income streams from various different countries.It has to stay below the threshold we spoke of if it surpasses that it will be taxed as if you are making an income. So it depends on the existence of double taxation treaty with each country. If both countries agree to waive taxing for the benefit other country you won't be taxed for that income in Turkey since it's taxed elsewhere. I hope that suffices your quench for pensions. Besides I have answered these questions in your previous threads too.

@avvuralgokhan Many people do not like me, but many do, taste.

What is unclear from your reply is that (like in Hungary) one would sell its property, the taxation would be pro rata (ie I have a property in Turkey for 3 years, I only have 40% in the capital gains), that is what I understand so far.

For the EU citizens would be interesting I think is how does this work in practice if you worked in some EU countries (also in the UK (ex EU)), I would think this is very interesting (YES, I would agree that a feedback on such a question would be difficult (and one could say a reply should be rewarded (I have time, but some others might not))

Again many people do not like me (fine), but I think my questions are not too bad.

@cdw057 As i say, there are many ways to ensure making the least expense while selling your property and it sometimes involves circumventing existing rules and navigating beyond the general trajectory. For that you will need a professional help.

I think this is a sufficient answer, pretty much sums up every inquiry.

Best Regards

@avvuralgokhan Please refer to my last post, but in addition I would like to say taxes can be a nightmare, but can also be a concenience to help, I am a bit upset you do not indicate this in any of your replies.

For example the 180 rule also applies to Turkey, so for those going to Turkey after 30th June they can be taxes fully in Turkey (possibly lower then country where they are coming from), creating a company is an interessting other topic (but not for now).

Just some examples which you SHOULD give sto the forum, but I will.

I moved quite a bit with my wife, OK we moved from the Netherlands to the UK, we (me) got a bonus, taxes normally by Dutch authorities also for health care etc. , having said that there is a clause the bonus is only payable on dedication to the company (ie being employed for a year after), so I argued this is a retention payment and not a bonus. (Net EUR 7.500  back).

At the time in the UK when spending abroad you were/could considered as a foreign resident, just to declare and its fine (EUR 10K) over 2.5 years, when I moved from Lux to Hungary I made sure I moved (officially) at the start of the year (April), EUR 10 K net in reclaims.

Moving from the UK also EUR 10K plus in the timing.

I had my company (Kft) in Hungary, car is more or less for free and so are health insurance

Example, there is a minimum for health insurance, however if you are employed (like my wife im my company) it does not apply, so big savings.

More examples to give, but you have to be more concrete, I am sad you do not give concrete examples for thos who want to move to Turkey.

Nice that you are a specialist, but if you give some money to people (for free) you will promote yourself.

Of course there are loopholes in Turkey as well (apart from the normal ones (which I think should be explained by you))

I am not a lawyer/tax-specialist etc, but I know peope can be hurt by taxes and if you can give them EUR 10K I am sure they will be happy to give you 1K
