China’s New Foreign Investment Law 2020: Changes and Challenges.

The Foreign Investment Law (FIL) will come into effect on January 1, 2020 with the current laws to Foreign Invested Enterprises (FIEs) being abolished at the same time.

With the implementation regulations on how to enforce the FIL, there are many questions about how FIEs will cope with these new changes during the 5 years transition period.

In this seminar HIBC invited two lawyer Michelle Wong and Kim Liu, whom are from our partner law firm JunZeJun Law Office, we will help you better understand the new law, as well as present what the major changes to the Chinese foreign investment regime are.

-What are the key changes that are introduced by the new law?
-What is “pre-establishment national treatment” and new “negative list management” system for foreign investment?
-Will it affect the registration, exchange currency, registered capital and total investment amount…?

Kim Liu
Background:
Qualified in New York State and in R.P.C..
SMU Dedman School of Law LL.M.
Bachelor degree in law and a Master degree in Constitutional and Administration Law from Northeastern University and L.L.M. from SMU Dedman School of Law

Professional Areas :
Cross-border M&A and investment in real estate, aviation, and high-tech, Chinese enterprises issuing US dollar bonds, bonds linked Notes, FDI, Compliance for Hong Kong listed company.

Projects Experiences:
Investment and M&A in USA, UK, Malaysia, Japan, Hong Kong, helped clients financing, corporate governance for China Mobile, Haier Group, China Ping An, Wal-Mart, Fantasia and Comicool, etc. FDI for foreign investor from USA, Canada and Australia etc.


Michelle Wong

Wong graduated with a Master of International Law from Sydney University and a LLB from Shenzhen University.
As a former Judge in Shenzhen District Court, Wong is very experienced in dispute settlement, contract, labor, and real estate property.
Being a lawyer, Wong works with foreign-related & capital markets legal service team at JunZeJun Law Offices. Her tasks include: dispute resolution; conducting legal due diligence, communicating with local government departments and drafting legal reports for listed company; advising clients and ensuring compliance to Company Law; representing the client in various business negotiations.
Wong is also an arbitrator in HNIAC.
Working Language: Chinese Mandarin, Cantonese, English
