Leaves and holidays

Hello everyone,

I needed some clarification about the leaves and holidays law.

I Had gone to India on emergency leave on 02.09.2019, and was back on 09.09.2019. The actual absence from work was 8 days, dating Monday the 2nd September till Monday 09 September (including Friday).

I have resumed duty today. But since Monday and Tuesday (09.09.2019 & 10.09.2019) were government holidays, our HR says that the leave will be considered including the 2 government holidays, making a  total of 10 days.

Is this right? can somebody explain?

It must be your company policy.  The annual leave entitlement as per labour law is excluding public holidays.

So its a legal practice of deducting leave?

Nope not legal.
