Divorcing in Japan

Reaching the decision to seek divorce can be hard. Filing the papers as an expat in Japan can be as taxing since a good grasp of legislations is needed and the process can prove to be tedious.

Where and how do you apply for a divorce in Japan? How long does it take for the process to be completed?

If the couple has children, which measures can be taken in order to protect their interests?

Which procedures should be completed so that the divorce is legally recognized in the country of origin?

Its a painful experience to remember, but yes its possible.
Best way to initiate the divorce is via mutual consent its called as Kyogi rikon, just fillup the divroce form and submit it to the City Hall. It must be hanko-ed (or signed) from both parties. Its the least expensive and quickest process. Min time needed is around 2 weeks. This patter is the least likely, because most of the time both parties dont agree mutually.

So then you can either opt for Cho-tei rikon, Saiban rikon or Shinpan rikon.
These are tough steps and may take several months, you would then probably need a lawyer (rikon-bengoshi) a lot of money, a lot of patience, and finally the courage to accept the ordeal.

But the most important thing to keep in mind that, the victim only can file for family court divorce. so somehow you have to convince that you are the victim of the partner's wrong doings.
