Legal Advice required

I have an apartment in Bodrum which is on the ground floor of a two storey block. Unfortunatly due to the recent rain we have a leak that is coming through the upstairs apartment into mine.

I have approached the owner upstairs to ask if he will contribute to having the roof repaired to keep the water out.
He has refused to pay so have to stump up the full cost myself to stop the water damage.

How do i stand legally and does the upstairs owner have a responsibility to contribute to the repair.

this is and old thread but i just recognized it.
roof is common area under property law, so there is collective ownership. each shareholder should participate to fix any trouble.
the best way is always to have a dwelling insurance. they know how to handle the procedure. if you dont have, you better apply to municipal constabulary to get official report and send a notary letter to prenotice saying that you will go to court.
maybe it is too late to answer yr question, just for others's reference.
