Permanent work contract in Hungary

Hello,

I am being offered a job in Hungary (Budapest) from one of the Hungarian company (in IT sector). It is a permanent position (and not contractual one) but, in the job contract the duration is mentioned as 2 years. When I asked about this, they mentioned that due to legal implications (labor laws) they cannot offer permanent like contract to a non-EU 3rd country nation. Is this really true ?

Is there such implication forced by law? Besides this, what are all other factors that I should consider in this regard?
If anyone can throw some light on this topic would be highly appreciated. Thanks in advance !!!

Shouldn't affect you at all, in the IT sector you'd have to be crazy to want to stick with an employer for more than 2 years.

"The validity period of a residence permit granted for the purpose of employment may not exceed the term specified in the specialist authority's assessment, that, however, may be extended up to the time indicated in the specialist authority's assessment given if the procedure was re-opened."

Not uncommon here: there is not a clear legal definition, just vague language like "specialist authority's assessment". So whatever your specialty is, two years may indeed be your work field's validity period assessment.

Meanwhile, the EU level Blue Card is good for the terms of the contract, up to 4 years. And renewable. This is fixed by EU law. Which is pretty clear.

If I hold a valid residence permit card with 1 employer, is it allowed by the law that I can switch my job within Hungary (With the same PR) ? Because on PR card, the name of employer shall be mentioned i guess. Do you have any information on this part too?

Sorry, but I do not have any answer for that.

Hi, I'm guessing by PR you mean the residence permit card. It doesn't contain your employer's name and you're free to use the same card with a different employer. My husband has a card and wasn't working initially, we just had to contact BMBAH (the immigration office, which is where we had to go even though he's an EU national) when he started work to let them know that he started to work, and we sent them his contract.

FWIIW: Right to work rules for EU nationals (who do not need a visa) are vastly different than work visas for non EU nationals.

Yep. Didn't check before I replied if Sanjay is EU national or not and as he's not - please don't take my word for what you need to do in case you change jobs, ask the authorities :) I would also wait until you actually change your job because the rules may change by the time it happens. Shifting goal posts and what not :blink:

For the purpose of employment, Hungary provides max. 2-year validity of work permit which is also called a residence permit. It's not a problem after every 2  years your permit will be renewed as long as you fulfill all the residence criteria according to law. Like you shouldn't be out of Hungary more than 90 days out of any 180 days period.
You can also apply for a permanent residence permit in Hungary as long as you finish 5 years of continuous residence in Hungary that would be given validity of 5 years.
