Hi everyone! Can someone help me or give opinion regarding Bf's situation in Riyadh right now. He arrived in riyadh last aug4 and he wanted to go home. His not working anymore because his depressed and wanted to go home. Can you gave us idea what are the penalties that we may pay? And how much? Can someone help us or what we should do. Thank you very much.

If you are saying 04 August 2016? He should resign today 04 October 2016 and he should only incur the cost of his flights and maybe agency fees.
If it goes beyond he will be charged for the iqama and cancellation fees. He is still within the 3 month probation period.

Thank you for the response. For the 3 month probation period, i think it should be nov4 right? Does the company will request him a reason for his resignation?

Not necessarily.

This what Labor Law - Article 40 - Clause 2 says:
A worker shall incur the costs of returning to his home country if he is
unfit for work or if he wishes to return to his home country without a
legitimate reason.

For someone who was brought by the employer, this includes visa charges+air tickets (to and fro)+other charges like medical etc. Say 6-8K SAR.

Is the iqama already included? He'll talk to his HR today to clear everything. He just wanted to go home. His dispressed :(

Hi again.l! He ask his area manager to terminate him, before the HR process and compute the penalties that he needs to pay. Question, does the process for termination will take long? Is there a procedure o papers need to be sign first before the hr computes the fees?  Thank you

Dear Madam,

Regarding your questions and concerns, please be advised that to answer your question you must look over the employment contract because not every contract has a probation period and if there is a probation period not all probation are the same length. Therefore, you must look over the contract.


for the expenses that might the employer be in charges are flight tickets, Igama fees, and visa fees.

Hi Sir! Question sir. As per advised of his manager, his already terminated. And HR advised him to wait for the update, is the process in HR will take long? What are the process now? Hope you can give us idea. Thank you
