Hi,

I need legal advice on Housing Law in Kuwait. The situation is that we are into the third year of our tenancy agreement and it was an automatic rolling contract. We were under the impression that after the 1st year we would be able to leave with our deposit being returned. However the Real Estate agency we are with are saying that we are tied in for a further year. Can anyone help with this. My husband says that the sales person said verbally that we would be free to leave after the year with deposit returned but this was verbally. The deposit was a substantial amount 1000kd.

We would like advice or to contact a solicitor if anyone knows of one.

refer to the details of the contract, and what it states ... in the viewpoint of the courts, if it's not on paper, it didn't happen (no such thing as verbal) ... most of the lease contracts here only state the term of the contract in reference to the deposit, beyond the dated contractually obligation your no longer on contract in reference to the deposit ... unless there are other stipulations regarding this within the document ... and it's a little early to acquire council as it's just another expense and they'll probable cost just as much if not more then your deposit.  Also consider that fact that you can't file a case till you have already incurred a loss, you can't file for someone 'saying' they're not returning the moneys, only against someone who 'didn't' return the money in question.  lol

What you need now is your leasing contract and someone who can read Arabic. It should be mentioned there as to what are the legal aspects should you decide to vacate your flat. When it comes to real estate it all boils down to what is stipulated in the contract.
