Hi, I am an EU citizen living in the Netherlands and my partner (foreigner from a country where citizens can travel to EU visa-free for 3 months every 6 months) has moved in with me recently and we have started the process of Verification Against EU Law.
Before the application we talked with a lawyer and they told us that if she wants to leave the country while the application is going on, she would need to get a return visa. The IND page states that:
You have submitted an application for an EU law review for the first time. This is a request to live with your family member who is an EU, EEA or Swiss national. Read which countries are in the EU and the EEA. Or an application to live with your Dutch child who is less than 18 years of age. You are waiting for the decision.
However last week she had an appointment at the IND desk for the return visa and they told her that because she doesn't need a visa to travel to the Netherlands, she doesn't need to get a return visa. But we are worried that her visa-free period has already expired and so they might not let her back in.
If anyone had any experience or information about traveling abroad while going through the Verification Against EU Law Application, I would appreciate if they can share it
