Hello folks,
Can anyone help me with this doubt?

If the employee doesn't want to renew the contract and leave the job, can the employer still hold the NOC back or bound to give NOC once thecontract period is over successfully (2 years)? Or company can keep it back?
If you don't have any bad records, of course.

Hi expatdax,

There is zero obligation or compulsion on the part of the employer / sponsor to give any expatriate employee the NOC - whether or not, the contract period is completed; whether or not, the employee is a good one or bad.

Even the Ministry of Manpower cannot dictate that an employee be given the NOC.

The decision of giving the NOC or not, rests entirely and solely with the employer / sponsor only.

And that is exactly why the majority of the expatriate employees feel that the NOC law is so very lopsided and so unevenly balanced.
