13th Month year end Bonus ???

hi everybody!!got a friend of mine an expatriate she is asking this question if the employer here in Mauritius are force to give her the 13th month year end bonus as an Expat? even though it is not in her contract??? :D

Yes, by law (End of year gratuity act 2001) every employer must pay one twelth of the salary as at December x no. of months that the employee has been in service for that year. This is implied and needs not be mentioned in the contract.

Moreover a contract is null and void if it contains abusive clauses, i.e clauses with are against the interest of the employee and against the minimum guaranteed by law.

Also, it must by law be paid before the 20th of december I think.

Coz until now my friend did not receive her 13 month only the Mauritians received there 13 months.
